Terms of Service
Last updated: August 27, 2026 · Effective date: [EFFECTIVE DATE]
These terms explain how our removal and hauling services work, what we need from you, and what you can expect from us.
Draft for attorney review. This page is a plain-English draft prepared for a California business. It is not legal advice and should be reviewed by a California business attorney before publication. Bracketed items are placeholders that still need verified information.
1. Who we are
These Terms of Service are an agreement between you (the “customer”) and [LEGAL BUSINESS NAME], doing business as [DBA NAME] (“we,” “us,” or “the company”).
- Business address: [BUSINESS ADDRESS]
- Phone: [PHONE NUMBER]
- Email: [EMAIL ADDRESS]
- Service area: [SERVICE AREA]
By requesting a quote or scheduling service, you agree to these terms. A signed, job-specific Service Agreement may also apply, and it controls the details of your individual job.
2. What our services include
Depending on what is written in your quote, our services may include labor, loading, transportation, disposal, recycling, donation, and basic cleanup of the immediate work area. We only perform work that is included in your written quote. Anything not listed in the quote is not part of the job unless we agree to it in writing.
3. Estimates are preliminary
Estimates given online, by text, or over the phone are preliminary. They are based on the information and photos you provide. The actual price may change based on:
- Actual volume and weight of the items
- Labor and time required
- Stairs, elevators, long carries, and site access
- Parking availability and travel distance
- Special handling requirements
- Disposal, landfill, or recycling facility charges
4. Final price approval before loading
Before we begin loading, we will look at the job in person, show you the final price, and ask you to approve it. Loading does not begin until you approve the final price. If you do not approve it, you may decline the work, subject to the cancellation policy below.
5. Ownership and authority
By scheduling service, you confirm that you own the items being removed or that you have legal authority to authorize their removal (for example, as a property manager, landlord, executor, or authorized agent). You are responsible for making sure removal is permitted by any applicable lease, HOA rule, court order, or other obligation.
6. Valuables and items you want to keep
Please point out valuables and remove anything you do not want hauled away before we arrive. Once items are loaded, they may be processed for disposal quickly, and recovery may not be possible. Check drawers, closets, boxes, and containers for documents, jewelry, keys, cash, medication, and keepsakes before the crew starts.
7. Access and safety at the property
Before we arrive, please make sure that:
- Pathways, hallways, stairways, and doorways are reasonably clear
- Pets are secured and children are kept away from the work area
- Legal parking is available near the pickup point
- Gates, garages, elevators, and locked areas can be opened for us
- Anyone whose approval is needed is reachable during the appointment
Tell us in advance about known hazards such as unstable flooring, mold, pests, exposed wiring, or structural damage.
8. Right to stop or refuse work
We may pause, reschedule, or decline any job that we reasonably believe is unsafe, unlawful, or beyond what we agreed to perform. This includes situations involving threats or harassment, unsafe structures, undisclosed hazardous materials, or a dispute about who is authorized to have items removed. If we stop work for these reasons, you are responsible only for work already completed and any charges disclosed to you.
9. Prohibited items
We cannot accept or transport:
- Hazardous chemicals, solvents, pesticides, and unidentified liquids
- Gasoline, diesel, propane, and other fuels
- Wet paint and other uncured coatings
- Asbestos or materials suspected to contain asbestos
- Explosives, fireworks, ammunition, and weapons
- Medical waste, sharps, and biohazardous materials
- Radioactive materials
- Any other regulated hazardous waste
If prohibited items are discovered on site, we will leave them in place and can refer you to an appropriate disposal facility.
10. Items that need prior approval or extra charges
Some items are accepted only with advance notice, and facilities often charge extra to accept them. These commonly include tires, refrigerators and other appliances containing refrigerant, electronics, mattresses and box springs, concrete, brick, dirt and soil, batteries, and other similarly regulated or heavy materials. Tell us about these items when you request your quote so the estimate is accurate.
11. Scheduling and arrival windows
Appointments are typically scheduled within an arrival window rather than at an exact time. Traffic, weather, disposal-site lines and closures, equipment problems, earlier jobs running long, and unsafe conditions can affect arrival times. We will make reasonable efforts to keep you informed of delays.
12. Cancellations, rescheduling, and deposits
- Cancellation and rescheduling: [CANCELLATION POLICY]
- Deposits: [DEPOSIT POLICY]
- No-shows: if no authorized person is available at the property during the scheduled window, or if we cannot access the items, the appointment may be treated as a cancellation under the policy above.
- Refunds: refunds, when applicable, are issued using the original payment method under the cancellation and deposit policies above.
13. Payment
- Accepted payment methods: [ACCEPTED PAYMENT METHODS]
- Payment is due on completion of the job unless we agree otherwise in writing.
- Returned or failed payments: you are responsible for the unpaid balance and any bank fees actually charged to us, to the extent permitted by law.
- Chargebacks: if you dispute a charge, please contact us first at [PHONE NUMBER] or [EMAIL ADDRESS] so we can try to resolve it directly. We will respond to disputes with documentation of the approved price and completed work.
14. What happens to removed items
Once items are removed, they become our responsibility to process and may be disposed of, recycled, donated, resold, or salvaged. We prioritize donation and recycling when practical and when appropriate facilities are available. We do not promise that any specific item will be donated or recycled, and we cannot return items after removal.
15. Property damage
We take care while working on your property. If damage occurs, please report it as soon as reasonably possible, and no later than [DAMAGE CLAIM DEADLINE], so we can investigate while the facts are fresh.
- Report damage by phone at [PHONE NUMBER] or by email at [EMAIL ADDRESS].
- Include the job date, address, a description, and photographs if available.
- We will review the report, respond, and work with you in good faith toward a reasonable resolution for damage we caused.
Removing large or heavy items can cause ordinary wear at doorways, corners, and floors, and pre-existing damage or wear may become visible once items are moved.
16. Rights that cannot be waived
Nothing in these terms limits or waives any right you have that cannot legally be waived under California or federal law. If any part of these terms is found unenforceable, the rest remains in effect.
17. California consumer rights
Some transactions arranged at your home may carry statutory cancellation rights under California law. When those rights apply, we will provide the notices and cancellation forms required by law with your job paperwork. This web page is informational only and does not replace any legally required cancellation notice or form.
18. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be handled in a court of competent jurisdiction in California unless the parties agree otherwise in writing.
19. Changes to these terms
We may update these terms. The “Last updated” date at the top of this page shows when the current version took effect. The version in place when you booked applies to that job.
